By using this site, you signify your consent and Agreement to these Terms of Use. If you do not agree to these Terms of Use, do not use the site.

Hosting services

Rockethost does NOT provide SMTP mail services by default with any hosting packages. These are available on request at an additional charge.

Rockethost reserves the right to suggest suitable alternatives to the customer and / or charge for excessive traffic as it deems necessary at its sole discretion.

Rockethost reserves the right to suggest suitable alternatives to the customer for excessive Web Server Processor usage as it deems necessary at its sole discretion.

Rockethost reserves the right to move a website between web servers and internet backbones, both within South Africa and internationally as it deems necessary. If a customer moves in excess of 2 GB traffic monthly then the customer will be contacted and various options will be presented.

Rockethost reserves the right (but does not assume any obligation) to inspect the contents of data that the customer transmits, receives or stores on an Rockethost Server to ensure compliance with this Agreement or any applicable laws regulations or codes of practice.

Disclaimers, Limitations and Indemnities

Rockethost will not be liable for any loss or damage, interruption of business, or any indirect, special, incidental, or consequential damages of any kind (including lost profits), regardless of the form of action, whether in contract, delict, or otherwise which may be suffered as a result of or which may be attributable, directly or indirectly, to the use and/or registration of the Customer's selected domain names/s OR ANY ACTION TAKEN BY Rockethost IN RESPONSE TO THE ABUSE OF THE DOMAIN REGISTRATION SERVICES WHICH IT OFFERS.

The Customer hereby indemnifies and holds harmless Rockethost against any loss whatsoever arising from any dispute or claim or other action occasioned by the Customer's use and registration of its selected Domain Name, even if Rockethost has been advised of the possibility of such damages;

Rockethost will not be liable for any indirect or consequential loss, damage, cost or expense of any kind, irrespective of how such damage or loss was caused, whether arising under contract, delict or otherwise, including, and not limited to, data loss or corruption, loss of profits, contracts, operation time and goodwill.

Neither Rockethost, its employees, affiliates, agents, third party information providers, merchants, licensers or the like, warrant that Rockethost's Server service will not be interrupted or error free; nor do they make any warranty as to the results that may be obtained from the use of the Server service or as to the accuracy, reliability or content of any information service or merchandise contained in or provided through the Rockethost Server service, unless otherwise expressly stated in this Agreement.

Rockethost expressly limits its damages to the Customer for any non-accessibility time or other down time to the pro-rata monthly charge during the system unavailability. Rockethost specifically denies any responsibilities for any damages arising as a consequence of such unavailability.

Rockethost is not responsible if an external company network and firewall is setup to block access to services Rockethost provides. If a client's network is setup to block certain ports or web addresses that compromise the services Rockethost provides it is the client's responsibility to ensure that their network configurations are changed as necessary.

99.9% Website Uptime Guarantee

The 99.9% website uptime guarantee is applicable only if the web server on which a customer 's shared web hosting account resides crashes or goes down at an unscheduled time. This guarantee is not valid if there is any network problem between the customer and the web server which prevents the customer from seeing the web server, e.g. if the customer 's ISP's link to Internet Solutions (IS) goes down or is faulty, but the web server Rockethost hosts is still up we are not responsible for the customer not being able to reach their website.

Rockethost is not responsible if any third party operated network or service experiences problems and outages (i.e. all network infrastructure and links, customer 's internet connection, firewall service managed by IS). If the applicable web server is up and running at all times then the website will deemed to have achieved 99.9% uptime.

The 99.9% website uptime guarantee does not apply to any scheduled downtime for maintenance of any of the Rockethost web servers. If there is scheduled maintenance to be done the customer will be notified at least 24 hours in advance. The scheduled maintenance will always be done after hours (based on Central African Time (CAT)) and the web server downtime will be kept to a minimum.

Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services.

Initial Set-up fees

Initial Set-up fees are non-refundable. Domain Name Registration fees constitute a once-off payment subject to certain renewal charges.

Domain Registration Protocol

If the domain to be registered is a .co.za domain then due to the Uniforum EPP system and policies, this can take up to 72 hours to complete and propogate to the Rockethost name servers.

Domain Transfer Protocol

Domain transfers will only be accepted by Rockethost once any outstanding amounts on the customers account has been settled and cancellation notice on the domain and it's attached plan has been received by Rockethost. Please view the Cancellations heading below for explanation on how to cancel. Any domain transfer tickets sent to Rockethost without proper cancellation notification will be automatically rejected for domain security and protection purposes.

Please note: Domain transfers can take up to five (5) business working days to process and complete.

Domain Renewals

Domains will automatically renew and you will be invoiced on renew completion. Should you wish not to renew your domain, we will require at least a calendar month notice before the expected renewal date of your domain.

Free Domain Registration/Transfers

Your free co.za domain registration/transfer is provided with the clear assumption that you intend to host with Rockethost for the foreseeable future. If your intention is to just use our free policy to get your domain registered and then immediately cancel your hosting account then we will not pay for your registration. If, however you do have a legitimate reason for cancelling your account immediately, then we will review it on the merits and pay for your registration in good faith.

Our hosting and free registration/transfer is sold as a bundled package and cannot be separated, i.e. we will not pay for your registration/transfer if it is not combined with any of our hosting accounts.

Rockethost will not tolerate any intended abuse of our free registration/transfer policy. Any such abuse will result in the immediate termination of your account and Service Agreement.

Reseller

Reseller plans are provided with a free co.za domain as your first domain. Any further domains added to your account are subject to separate domain registration fees. Should you wish to register a non co.za domain as your first domain, you will be charged with an additional setup cost during your payment.

As a reseller, you acknowledge to register domain names in the correct beneficiary details of the domain name and not in your own details.

Mail Size Limitations

Individual mail sent to the customer's POP3/IMAP box or forwarded to the customer's existing email address may be limited to 3000kB in size each.

Website Design

Content

The term “content” used herein shall include without limitation any text, scripts, photographs, illustrations, images, graphics, sounds, music, audio, video and interactive features (and the trademarks, service marks and logos contained therein).

Initial Setup

Rockethost will assist with your initial setup and configuration by installing your chosen website design template on your behalf. You will then need to supply all content to us in order for us to complete your website configuration.

Failure to provide Rockethost with your desired website content will result in a delay of your website going live. Rockethost cannot be held liable for this delay.

Website Management

Should you require Rockethost to manage your website content on a monthly basis after your website has been setup, configured and made live, then Rockethost will do so at an additional monthly fee.

This monthly fee includes changing of website page text, and adding or deleting web pages only. Any additional graphic design, or web development will need to be quoted for and is not included on your website design subscription fee or additional management fee.

Third Party Content

Should you require stock photos for your website and require Rockethost to obtain these, Rockethost will send you a quote for these items which is excluded from your website design subscription fee.

If your content is accompanied by or requires consent to a license agreement from a third-party provider then your use of the content is subject to the terms and conditions of such license agreement, which are in addition to the terms and conditions of this Agreement.

Rockethost expressly disclaims any liability or responsibility regarding your use or misuse of any third-party content.

Should Rockethost incur any claims arising from your use or misuse of third-party content, you acknowledge and agree that you will protect, defend, indemnify Rockethost against all claim brought forward against Rockethost.

Website Hosting

Cancellation of your Website Design subscription for any reason terminates your website hosting as well.

SVN Free Trial

The SVN free trial plan is limited to one free month using the platform from the time of signup.

Thereafter you will be charged at R19.99 per month. Should you wish not to purchase the plan then your SVN repository will be immediately terminated.

Use at Customer's risk

Rockethost will exercise no control whatsoever over the content of the material hosted on, or the information passing through the Rockethost network and in no way moderates such content.

Customer expressly agrees that use of Rockethost's Server(s) and Services are at customer's sole risk.

Rockethost is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on the Rockethost web servers, including e-mail, databases and site content.

Restrictions on Use of Materials

Materials in this website are copyrighted and all rights are reserved. Text, graphics, databases, HTML code, and other intellectual property are protected by South African and International Copyright Laws, and may not be copied, reprinted, published, reengineered, translated, hosted, or otherwise distributed by any means without explicit permission. All of the trademarks on this site are trademarks of Rockethost or of other owners used with their permission.

Database Ownership, License, and Use

Rockethost warrants, and you accept that Rockethost is the owner of the copyright of the Databases of Links to articles and resources available from time to Rockethost and its contributors reserve all rights and no intellectual property rights are conferred by this agreement.

Rockethost, grants you a non-exclusive, non-transferable license to use database(s) and information accessible to you subject to these Terms and Conditions. The database(s) and information may be used only for viewing information or for extracting information to the extent described below.

You agree to use information obtained from Rockethost's databases only for your own private use or the internal purposes of your home or business, provided that is not the selling or broking of information, and in no event cause or permit to be published, printed, downloaded, transmitted, distributed, reengineered, or reproduced in any form any part of the databases (whether directly or in condensed, selective or tabulated form) whether for resale, republishing, redistribution, viewing, or otherwise.

Nevertheless, you may on an occasional limited basis download or print out individual pages of information that have been individually selected, to meet a specific, identifiable need for information which is for your personal use only, or is for use in your business only internally, on a confidential basis. You may make such limited number of duplicates of any output, both in machine-readable or hard copy form, as may be reasonable for these purposes only. Nothing herein shall authorize you to create any database, directory or hard copy publication of or from the databases, whether for internal or external distribution or use.

Liability

The materials in this site are provided "as is" and without warranties of any kind either, express or implied. Rockethost disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Rockethost does not warrant that the functions contained in the materials will be uninterrupted or error-free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or other harmful components. Rockethost.co.za does not warrant or make any representations regarding the use or the results of the use of the materials in this site in terms of their correctness, accuracy, reliability, or otherwise. These Terms of Use will apply to every access to Rockethost reserves the right to issue revisions to these Terms of Use by publishing a revised version of this document on this site: that version will then apply to all use by you following the date of publication. Each access of information from Rockethost will be a separate, discrete transaction based on the then prevailing terms.

These Terms of Use and any license which may be granted to you may not be assigned or sublet by you without Rockethost's written consent in advance.

These Terms of Use shall be governed by, construed and enforced in accordance with the laws of South Africa, as it is applied to agreements entered into and to be performed entirely within such jurisdiction.

To the extent you have in any manner violated or threatened to violate Rockethost and / or its affiliates' intellectual property rights, Rockethost and / or its affiliates may seek an interdict or other appropriate relief in any court in South Africa having the competence and Jurisdiction to hear the matter, to which you consent to exclusive jurisdiction and venue in such court(s).

At the discretion and instance of Rockethost, any other disputes may be resolved, without litigation, as follows:

If a dispute arises under these terms of use, the parties agree to first try to resolve said issue with the help of a mutually agreed-upon mediator in the following location: Johannesburg, South Africa. Any costs and fees other than attorney fees associated with the mediation will be for your, the user’s, account.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, the parties agree to, at the discretion and instance of Rockethost, submit the dispute to either binding arbitration at Johannesburg, South Africa and/or to seek other recourse any court in South Africa having the competence and Jurisdiction to hear the said matter.

If any provision of this agreement is void or unenforceable in whole or in part, the remaining provisions of this Agreement shall not be affected thereby.

Return Policy – Professional Services Rendered

Please Note that any moneys paid to Rockethost as payment for any services rendered in terms of its offerings shall be deemed to have been properly earned once payment has been effected. The nature of our product and service offerings is such that we will never ask for payment unless you are completely satisfied with the information you have supplied us with and specifically request to be charged for us to revert to you. In this regard no refunds or chargebacks of any nature whatsoever shall be contemplated by Rockethost.

Termination

Should customer breach of any of the terms and conditions contained herein, including but not specifically limited to the payment terms, Rockethost has the right (solely at Rockethost's discretion) to immediately demand payment of the full amount owing and demand compliance forthwith with all the terms and conditions, alternatively to terminate the agreement and services forthwith, in either instance without in any way derogating from any common law, contractual and or delictual rights which Rockethost may have.

Rockethost reserves the right to suspend or terminate the service of any customer that does not comply with the terms and conditions, Acceptable Use Policy, Acceptable Hosting Policy or any other contractual obligations.

Non Payment

In the event of non-payment of an invoice by the stipulated Due Date, Rockethost reserves the right to hold the customer liable for the total amount due pursuant to such invoice.

Rockethost may stop the supply of new services to the customer and/or terminate current services held by the customer if payment of any invoice is not made by the Due Date, or if a petition for liquidation is filed by or against the customer, or if the customer goes out of business or announces intention to do so.

If the supply of new services is stopped or the existing services are terminated in accordance with section 6, the full outstanding balance becomes due and payable immediately.

• If the customer pays the amount due in full, the customer may have their existing services re-activated and also purchase new services.
• If the customer neglects to pay the amount due in full, Rockethost will submit the full delinquent amount for Collections. In the event of the account being handed over to an outside collection agency, any costs incurred as such will be for the customers’ account.

Rockethost will not be held liable for the loss or suspension of customer services due to non-payment.

In the event of suspension due to non-payment, Rockethost reserves the right to place a “non-payment” page on your domain. Furthermore, the DNS of your domain will remain unchanged until full payment for the outstanding balance on your account has been received.

If the preferred method of payment used by a customer is EFT, it will be the sole responsibility of the customer to ensure their payments are made using the correct beneficiary reference as indicated on all invoicing. Failure to comply may result in an incorrect allocation of the customer payment which may cause service disruption as a result of the account being suspended due to non-payment.

Payment Methods and fees

Rockethost only accepts payments via wire transfer (EFT), debit order and credit card. Rockethost accepts MasterCard, and VISA.

A processing fee of R50.00 (Incl. Vat) is charged on all returned debit orders.

The merchant outlet country at the time of presenting payment options to the cardholder is the Republic of South Africa and the transaction currency is South African Rand (ZAR).

Cancellations

A cancellation request in respect of any service must be completed via the customer area https://www.rockethost.co.za/Customer or via email to Rockethost one calendar month (30 days) before the date of ceasing the service.

Rockethost reserves its rights to change its prices at any time on reasonable notice. Rockethost reserves the right to stop offering certain web hosting package types if it deems it necessary. Rockethost will then either provide the web hosting service for the remainder of the time that has been paid for or refund the amount paid for that specific package.
